The efficient use of intellectual property rights is an important aspect to support high-quality economic development. In accordance with the relevant requirements of the State Intellectual Property Office and in combination with the actual situation in Shanghai, the Shanghai Municipal Intellectual Property Office has actively carried out the pilot work of patent open licensing, and formed a number of phased pilot results. Since the pilot, 50 enterprises and institutions have been promoted to issue 240 patent open license statements, 610 patent open license statements from other provinces and cities such as Tsinghua University have been introduced, 45 patent open license transactions have been facilitated, including 27 free patent open licenses, and the country's first patent open license transaction guarantee insurance has been implemented.

The first is to strengthen policy guarantees. Formulate and publish the "Shanghai Patent Open Licensing Pilot Work Plan", clarify the expected goals, working mechanisms and key tasks of the pilot work, and promote the establishment of a working mechanism for information release, transaction compliance and service guarantee. Strengthen performance incentives, and give 3,000 yuan per piece of performance rewards and subsidies to the open licenses of patents that have reached transactions.

The second is to guide multi-party participation. Give full play to the advantages of the functional park of the municipal-level intellectual property operation service agglomeration area in information distribution and supply and demand docking, and organize nearly 30 patent open licensing publicity activities in various forms such as matchmaking meetings, promotion meetings, auctions and "intellectual property service miles" activities.

The third is to explore model innovation. It has innovated and built a "patent supermarket" with "low-price transactions and high-frequency circulation" in 7 districts, and the "Min Zhihui" patent supermarket in Minhang District has successfully reached tens of millions of patent open license transactions. Exploring the free and open licensing model of patents, and supporting free and open licensing of public welfare patented technologies such as Ele.me and Bilibili, a total of 20 transactions have been made.

Fourth, strengthen risk control. It is the first in the country to implement patent open license transaction guarantee insurance, providing insurance protection of 1 million yuan for 4 patents (license fee of 400,000 yuan) that have been traded through patent open licensing, helping both parties to prevent potential risk disputes.
